| Making ARES and the James R. Webb ARES Foundation Part of Your Estate Plan |
There are many ways to help advance the mission and work of the American Real Estate Society through the James R. Webb American Real Estate Society Foundation (“Foundation”). One novel way to do so is to include the Foundation in your estate planning documents. If you wish to include the Foundation in your estate plan, we recommend, in the strongest possible terms, that you consult your attorney or an estate planning professional. If you elect to support the Foundation, we also ask that you share your plan with us (see below for a sample letter or notice). For consideration in your estate planning conversations, identify whether you wish to make a restricted or an unrestricted gift. For an unrestricted gift, the donation will be used for Foundation determined purpose(s). For a restricted gift, the donation will be used for the purpose(s) you elect. Sample language is provided below describing how one might frame each type of estate gift. Examples of restricted gifts include though not be limited to doctoral student travel funding to an ARES or sister society meeting, a named prize for outstanding research, research support for an early career scholar. Alternatively, you are welcome to make an un-restricted gift that allows the Foundation board to allocate your gifts as the needs arise. Sample Language: Un-Restricted GiftI bequeath to James R. Webb American Real Estate Society Foundation, a nonprofit corporation registered in the state of Ohio, the sum of $__________________ [or property described herein] to be used by the Foundation in its sole discretion for its general purposes. OR I bequeath all the rest of my estate [or ___ percent (__%) of the rest of my estate] to James R. Webb American Real Estate Society Foundation, a nonprofit corporation registered in the state of Ohio, to be used by the Foundation in its sole discretion for its general purposes. Sample Language: Restricted GiftI bequeath to James R. Webb American Real Estate Society Foundation, a a nonprofit corporation registered in the state of Ohio, the sum of $__________________ [or property described herein] to be used by the Foundation for the following purpose(s): ______________________________________________. OR I bequeath all the rest of my estate [or _____ percent (_%) of the rest of my estate] to James R. Webb American Real Estate Society Foundation, a a nonprofit corporation registered in the state of Ohio, to be used by the Foundation for the following purpose(s): ___________________________________________________________. Sample Note to James R. Webb American Real Estate Society Foundation(Date) To the Chairperson of the James R. Webb American Real Estate Society Foundation, This letter serves as notice that I have made the James R. Webb American Real Estate Society Foundation a part of my estate plan. Specifically, I have (created a will or living trust/modified an existing will or living trust) and included the following language germane to the Foundation: (Insert language describing gift here) I reserve the right to amend this gift at any point without written notice to the Foundation.
